Борьба с пиратами не знает жалости
Таможенникам дают право беспрепятственно задерживать товары по подозрению в контрафакте. Дума рассматривает соответствующую поправку в Таможенный кодекс (ТК).
Если поправка вступит в силу, любая партия товаров может задержаться на границе минимум на 7 рабочих дней. Определять, контрафакт это или нет, сотрудник таможни будет на свое усмотрение. Сейчас работники Федеральной таможенной службы (ФТС) имеют право задерживать товары только по просьбе правообладателя.
По новой версии ТК, задержав товары, таможенник обязан не позднее следующего дня проинформировать об этом правообладателя и декларанта. По просьбе правообладателя срок задержания может быть увеличен до 10 рабочих дней. Уменьшение срока также осуществляется только по просьбе правообладателя. Чьи уши торчат? Формально авторами поправки в ТК являются шесть депутатов Госдумы от "Единой России". Однако тот вариант поправки, который они предлагали, уже подвергся корректировке со стороны федерального правительства.
Сейчас в Думе рассматривается правительственный вариант. Эксперты не сомневаются, что настоящие авторы поправки находятся в ФТС. По словам сопредседателя Союза потребителей России Анатолия Голова (экс-депутата Госдумы), министерства и ведомства часто просят депутатов заявить проект закона от своего имени. Это позволяет обойти его рассмотрение на правительстве. Законопроект вызывает неоднозначное отношение, и правительство не хочет вносить его от своего имени. "Это чисто коррупционный законопроект, который позволяет творить произвол", -- убежден Голов.
