В Україні апеляційною інстанцією у цивільних справах є цивільні судові палати апеляційних судів загальної юрисдикції, у межах територіальної юрисдикції яких знаходиться місцевий суд, який ухваливоскаржуване рішення.
Сторони у справі мають право оскаржитив апеляційному порядку рішення суду першої інстанції повністю або частково.
